Terms and Conditions
These Terms and Conditions (“Terms”) govern NextGen One and each Customer that books the service to collect bins (“Service”) provided by NextGen One. Please read the Terms carefully as they contain important information. You acknowledge that you the Customer have read, and you agree to be bound by these Terms upon booking and receiving the Service.
Note: “Us” refers to “NextGen One” and “You” refers to the Customer. NextGen One is the trading name of ALL Civil Media Pty Ltd (ABN: 24 130 099 259)
Booking
Your hire of bins for waste collection purpose is subject to acceptance by NextGen One, of which acceptance will be acknowledged (in writing via email) after NextGen One has received Your fully completed booking, the payment related to Your booking and any required supporting information. NextGen One may in its absolute discretion for any reason refuse to accept Your booking.
All the prices for booking for the bins are published on the NextGen One website (www.lightblue-grouse-286888.hostingersite.com). NextGen One reserves the right to change the prices at any time but changes will not affect bookings which have already been confirmed in writing by NextGen One. NextGen One may also apply specific discounts and promotions to any prices from time to time.
Payment for Bin Hire
The Customer can book and make the payment via NextGen One website using an authorised credit card Payment System (Square Payment System, Stripe or PayPal Payment Gateway).
Should You select to pay at the delivery, the payment can be made by credit card through the Square Payment Gateway or payment made in cash to the Driver who delivers the bin. Receipts for payment will be provided to the Customer via email.
NextGen One ensures that the NextGen One website is secure (You would see https:// prefix to the NextGen One website). NextGen One maintains an active Secure Socket Layer (SSL) certificate on its website at all times. All payments accepted by NextGen One is processed externally by reputable authenticated and secure merchant service such as Stripe, Square Payment and PayPal Payment Gateways. We do not process credit cards manually.
You are aware that full payment for all booking of the bins are required prior to or at the delivery of the bins unless prior arrangements have been made with NextGen One or a valid Purchase Order is provided with terms of payment agreed upon by NextGen One. If no payments is made, the bins will not be delivered.
Cancellations and Changes
Notification of cancellation of Your booking of bins must be made in writing via email (Notification) to NextGen One. The notification must include all relevant information. Any phone calls advising of cancellations will not be accepted. This is to avoid any third party cancelling the booking of your bin.
Once an order has been received any cancellation will incur the following fees:
- If cancelled the day before the bins are booked to be delivered, then there will be no charge and the money paid will be refunded less any merchant fees for such refund.
- If cancelled on the day of delivery, then the Customer will be refunded the Invoice amount less $165.00 (including GST).
When an attempt is made to collect the bin and the Customer requests NextGen One to come back on another time/date then a minimum call out fee of $165.00 (Including GST) per bin will be charged.
If at any time after a bin has been delivered to the Customer’s property and the Customer decides they want a different sized bin, a minimum fee of $165.00 (Including GST) in addition to the size upgrade cost will be charged to uplift the original bin and replace it with the new bin.
Restrictions and Ownership of the Bins
All bins delivered to the Customer for the purpose of waste collection is the property of NextGen One and will remain the property of NextGen One whether it is placed on the Customer’s property or on the nature reserve.
The Customer has no right or claim to any interest in the bins to secure any liquidated or un-liquidated debt or obligation that NextGen One owes the Customer.
Bins are not to be moved or relocated on site following delivery by NextGen One, unless prior arrangements are made by the Customer. Note, the truck requires enough room to load and unload the bins. Damages to bins incurred during hired period will result in additional charges at the market value of the bin at the time of collection.
Materials in the Bin
The Customer must only place the material or type of waste that the bin is hired for. Mixing of different categories of waste will incur additional cost for disposal which will be passed on to the Customer.
Materials in the bins will remain the property of the Customer until it is disposed by NextGen One and full payment is made by the Customer and the Customer has complied with these Terms and Conditions.
Excluded and Prohibited Items
Customer must NOT put the following items in the bins:
- Asbestos, fibro or fibro cement sheeting
- Old insulations
- Food waste and packaging
- Gas bottles
- Any liquids, including paint
- Chemicals of any kind
- Hazardous material
- Medical waste
If any of the above items are found in the bins at the disposal site, the Customer will be liable to pay additional fee for its safe disposal of the whole load, plus $55 (including GST) of administration cost. These amounts will be deducted from the Customer’s credit card on file.
Site Access and Conditions
The Customer shall be responsible for ensuring complete and suitable access to the Site Address and Site Contact for the bin delivery and collection point.
The Customer warrants that any access provided by the Customer for the Bin location is sufficient to bear the weight (both empty or loaded) of the bin and vehicle combined. The Customer must ensure the conditions, including access heights, ground surface and surrounding area are suitable for the placement and delivery of the Skip Bin.
NextGen One accepts no responsibility whatsoever for any damage caused to the ground, surface, road, path or passage of the Site Address or the location designated near or in proximity to the Site Address for the delivery and placement of the Bin.
Maximum Weight and Load Limits
Specified weight limits are provided on our website. Unless otherwise agreed prior, these limits are to be observed and strictly adhered to. NextGen One drivers have the right and discretion to refuse any load they deem to be unsafe or overloaded in line with legislation, guidelines, and our company policy. Bins that exceed the maximum weight limit, will incur an additional charge of up to $280 per tonne.
Bins must not be filled above the rim or compressed. Nothing is to protrude above the rim at all. If bin is overfilled, we retain the right to remove items as necessary in order to make it legal to transport. These items will be placed next to or near the bin. If this is not possible to do for whatever reason, we may tip the contents of the bin back onto your property without a refund of any kind. In such case we are not liable for any damage incurred to your property or any other objects or vehicles that are near the bins.
The Customer may book additional bins to dispose material that does exceed the capacity of the bin. NextGen One will make every effort to get the bins to the Customer on time to minimise any inconvenience to the Customer.
General
NextGen One reserves the right to amend these Terms from time to time and You will be subject to the Terms in force at the time you book the service from NextGen One.
The failure, delay, relaxation or indulgence on the part of a party in exercising, in part or whole, any power, right or remedy conferred upon that party by these Terms shall not operate as a waiver of that power right or remedy.
If any provision of these Terms is invalid or not enforceable by a court of competent jurisdiction, the relevant Term is to be read down and shall otherwise be capable of being severed to the extent of the invalidity or unenforceability without effecting the remaining provisions of these Terms.
These Terms are governed by and are to be construed in accordance with the laws in force in New South Wales. Each party irrevocably and unconditionally submits to the non-exclusive jurisdiction of the course of New South Wales and waives any objection that it may have that proceedings have been brought in an inconvenient forum.
Entire Agreement
These Terms and any document expressly referred to in them, represent the entire agreement between You and NextGen One in relation to the purchase of Program, Training Material and Documentation and supersede any prior agreement, understanding or arrangement between Yourself and NextGen One whether written or verbal.
Both NextGen One and Yourself acknowledge that in entering these Terms, neither has relied on any representation, undertaking or promise given by the other or be implied from anything said or written in negotiations between NextGen One and Yourself prior to entering these Terms, except as expressly stated in these Terms.
Neither NextGen One and Yourself shall have any remedy in respect of any untrue statement made by the other, whether in writing or verbal, prior to the date of entering these Terms (unless such untrue statement was made fraudulently) and the other party’s only remedy shall be for breach of contract as provided in these Terms.
Privacy
NextGen One is committed to protecting your privacy and the confidentiality and the security of personal information provided by you. The personal information you provide is necessary to process your registration form which may include updating your record and profile information. We may contact you about future professional development and associated events, latest news and updates, and to generally provide you with information on services and benefits.
